Indeed. But non lawyers like me, who cud give a fap about the law, would not know or even care to know that a judge would not recommend that a case be thrown out; or even another judge, making a comment.

I agree the word is would have cleared up any ambiguity but maybe that extra work wouldn't fit in the space alloted for the headline. But at least the reader understands what teh story is about from the first paragraph.
The sub-editors at all of the papers, especially The Tribine and journa, are horrible when it comes to headline writing.
