"First of all, The Bahamas had to make a statement on that issue because the death penalty, capital punishment, is still on our laws, and until such time as amended or repealed, it has to be qualified in that way, that the death sentence is applicable here in The Bahamas," he said.
He reiterated the government’s commitment to capital punishment, and restated the situation.
"The matter is before the courts. The other day the court ruled that a death penalty was an appropriate sentence. That issue will be carried forward, and will no doubt probably be appealed, and then we’ll deal with that issue, but until it is resolved, the death penalty is the law of The Bahamas."

The reason why is when one is faced with the death penalty as with any other charge, the convicted has the right to appeal. After all local appeals are exhausted and are not overturned. The last course is to go the Privy Council in London (I still ain't know why if we "Independent"). The Brits have ruled the death penalty as unconstitutional so therefore any death penalty case that goes to the Privy Council will be reduced to a lesser charge. When we do away with colonialism then we could practice capital punishment.
SpamStopper 02-28-08, - 05:15 PM Kick the Privy Council out of the Bahamas once and for all!!!
Privy Council = MALWARE!!! :hammer::hammer:

This is one of the best explanation of the issue I've seen. I'd like to know how we call The Bahamas "independent" as well.
Zero, son of The Bahamas. 02-29-08, - 07:47 AM Well let me tell you that death penalty and such is whatever. What needs to be done is taking care of the prisoners with better cells and better study options in order to better safe guard there return into society. I can give the gov. a run down on that matter anytime see.

praetor 02-29-08, - 09:46 AM Bahamians won't do away with the Privy Council because they don't know the first thing about independence.
We need to do away with this "British system" of judicial process and make our own.
I mean, why would we want to be like those panty-waists anyway?

If the Privy Council is to try cases under Bahamian law and the death penalty is constitutional under Bahamian law, why does the Privy Council have to consider their ruling in their country?
As an independent nation, what the UK does with their laws has no bearing on the Bahamas, right? <-- looking for legal opinion here
hiphopanonymous 02-29-08, - 12:04 PM I think one of the main reasons neither the PLP or the FNM will move ahead with an execution is because they fear the backlash. Amnesty international will lead an international charge against the Bahamas which will be supported by many countries, NGO's, and important people (celebrities).
Also, it's a huge political risk. The international heat combined with an effective opposition attack could cost the government in the next election.
It might be more effective and beneficial for the government to look into changing the law so there is a focus on reforming criminals in Fox Hill (right now many come out of the Fox Hill University with a bachelor's in crime as their only education), building new prisons, and altering/increasing the sentences instead of focusing on hanging.

That's crazy talk. Amnesty International is going to condemn us for executing murderers that have been given due process of law, while the United States fries suckers in an electric chair?
Give me a break.
The reason why the plp and fnm wont do what needs to be done is because they lack the balls to do so.
better to let the mob mete out justice when required. then maybe we'd have some decorum in this country.
