See, B21, this is where I have a problem, it doesn't matter to me how "hot" the parties involved are. She is definitely still a child and cannot in any circumstance give consent for anyone, whatever their age, to have sex with her legally. It is time our young men (and older ones)started thinking with the head on their shoulders instead of the one lower down. SMT

4. For the purposes of this Act, "sexual intercourse" includes-
Definition of sexual intercourse.
(a)
sexual connection occasioned by any degree of penetration of the vagina of any person or anus of any person, or by the stimulation of the vulva of any person or anus of any person, by or with-
(i)
any part of the body of another person; or
(ii)
any object used by another person,
except where the penetration or stimulation is carried out for proper medical purposes; and
(b)
sexual connection occasioned by the introduction of any part of the penis of any person into the mouth of another person,
and any reference in this Act to the act of having sexual intercourse includes a reference to any stage or continuation of that act.

Hell yes to your second question again!!! Are you slow or something, if this young girl has been removed from another private school before for the reasons of the same nature to this case, then it also says alot about what is her developing character and what she is not being taught!

I agree AA, but i can see where b21 is coming from.

That's what i was talking about earlier, in terms of changing the law in the light of new circumstances. It takes two to tango, and probably when these bills were drafted, it was at a time where young girls were coerced into sexual relations with an older man by same older man.
now we have to rethink that stance. just look at the young girl whose bag got "stolen" and she ran away after the thief.............didnt they find her with the guy, inflagrante delicto? that alone, coupled with several other cases too (even one from your island AA, that i know about) should make our MPs really rethink the laws on the books. of course, get the public involved and seek their views on it.

The Act is actually from 1991!
Anyway Section 1 Part 10 1&2 says
Sexual intercourse with a person under fourteen years.
10. (1) Any person who has unlawful sexual intercourse with any person under fourteen years of age, whether with or without the consent of the person with whom he had unlawful sexual intercourse, is guilty of an offence and liable to imprisonment for life subject to, on a first conviction for the offence, a term of imprisonment of seven years and in the case of a second or subsequent conviction for the offence, a term of imprisonment of fourteen years.
(2) Any person who attempts to have unlawful sexual intercourse with any person under fourteen years of age, whether with or without the consent of the person with whom he attempted to have unlawful sexual intercourse, is guilty of an offence and liable to imprisonment for fourteen years subject to, in the case of a second or subsequent conviction for the offence, a term of imprisonment of eight years.
And Section 1 part 28 say:
Mandatory reporting of suspected abuse of minors.
28. (1) Any person who-
(a)
is the parent or guardian of a minor;
(b)
has the actual custody, charge or control of a minor;
(c)
has the temporary custody, care, charge or control of a minor for a special purpose, as his attendant, employer or teacher, or in any other capacity; or
(d)
is a medical practitioner, or a person registered under the Nurses and Midwives Act as a nurse or midwife, and has performed a medical examination in respect of a minor,
and who has reasonable grounds for believing that a sexual offence has been committed in respect of that minor, shall report the grounds for his belief to a police officer as soon as reasonably practicable.
(2) Any person who without reasonable excuse fails to comply with the requirements of subsection (1) is guilty of an offence and liable on summary conviction to a fine of five thousand dollars or to imprisonment for a term of two years or to both such fine and imprisonment.
(3) No report made to a police officer under the provisions of subsection (1) shall, if such report was made in good faith for the purpose of complying with those provisions, subject the person who made the report to any action, liability, claim or demand whatsoever.

That's bull! I will always look at matters like this with a open eye. She is not at the legal age, but neither is he. So why does the fault automactically fall on the shoulders of the male????? The age doesn't play such a factor when you and many others state that girls mature faster than boys. If it is true that this young lady has been involved in a incident like this before and was removed from that school because of it then tell me what does that mean????? Cheaper she is home schooled in that huge *** house her father built out of many honest and dishonest Bahamian peoples money. I am going to call him tomorrow!

emboldened part means that he should go to jail. all right.
BUT 1991?????????????????? lol that was more than 15 years ago, almost a whole generation has passed. yup laws need to change. SOMETHING has to be done........

Now you see, you could get me runnin hot up in here right now :) Although in some ways I do agree with what you are saying.
In my view, if the law were to be amended, then possibly decriminalise a consensual relationship between two teenagers with only, maybe, a difference in age of a couple of years (as in this case) although I still think that the age of consent is there for a very good reason and that 13 is waaaaaaaaay to young to be contemplating having sex. However, once the age gap is wider and you are talking about an adult having a sexual relationship with a child, den lock dere azz up n throw away the key!

Yeah.....or something, because I am not concerned about other people's business, no matter who the hell they are. You obviously don't know the parties involved, because you are getting information second hand, and you need it verified - gossip is not truth in my book. Life is complex, "developing character".....perhaps the little girl has multiple issues. You are appear to be VERY concerned about the details of the incident.... why is that?

B21, I am not saying that she was right in what she did and yes, if there is a history then she should also receive punishment and more to the point some serious counselling to find out why she is acting in a promiscuous manner. He is however of a legal age to engage in sex with someone also of legal age.

I am not obsessively concerned with other peoples business either! With this country being in that state that it is in, this is a debatable topic and that's why we are here on this forum. To debate among ourselves what really happened, and the way that we should go to prevent it from happening again. You can't say to some degree that you aren't concerned about people's business because that is basically what we do here, take a drink of reality! You read the papers and the tabloids which are filled with other peoples business probably everyday GOD sends, so shove the bull crap somewhere else.
Unlike most of you guys here I reserve my rights to speak on any issues until I find out more about the topic of discussion. Do you know the parties that are involved? So is your information any more purer than of mine???? Gossip is not truth, but I never confirmed or condemned anyone didn't I? This is the type thinking that you cops allow criminal attorneys to free all these criminals ya know! No logic is applied to what is written or read!
My concern comes from wanting to know the truth before I open my mouth and comment on anything, you should try it sometime! COP!:hammer:

Of course not Ann, I would never subject myself to such a low standard! By the way, I have been tried by under age teen girls, and have even shared it here on BI before. I consider myself someone with good morals, I try my best to keep my daily life and family on the "Up & UP"! I fall sometimes, but there are certain boundaries that I will never cross. that being one of them!!
And this may sound ill informed but I was under the impression that the legal age for consentual sex is
16 for females
18 for males
please correct me if I am incorrect with some legal proof.
