In a move that some observers viewed as dramatic and a signal that the Grand Bahama Port Authority ownership feud is far from over, Senior Justice Anita Allen on Monday recused herself from the case, accusing the Court of Appeal of interfering in her judicial independence.

The Judiciary is in a feud all by itself, and we want them to have a hand in ending the Port feud...LMAO!!!

Not to hijack the thread but is the learned judge related to Theresa Moxey Ingraham? The resemblance is uncanny!

I also saw somewhere today where Sir Jack is rying to get rid of some key Port employees!

This is one matter where I would not have problem with a foreign judge presiding over it's proceedings.

There must be tremors on Taino Beach where Mr. Edward St. George is rolling over in his grave!

Just looking at the names of the lawyers representing the diffierent companies has opened my eyes to how deeply the influences of the the Port is entrenched in the powers that be in this country.


No wonder Alfred Sears jumped up in the House when the PM talked about dealing with the Port. I wonder if this is part of the reason the P.L.P did not to help to reslve this issue during their tenure.

Imagine that, a spokesman in the House of Assembly!

Sir Jack ain no saint and it is obvious that he is only looking out for his own interest. The Port Authority was started by the ex-convict Wallace Groves and now one of it's co-owner's is deliberately and secretly divesting the company of it's assets. He is quietly doing in another way, what Wallace Groves did to his stockholders, talk about history repeating itself. I hope that history also repeats itself with the jailtime!

At this rate by the time some resolution makes an appearance, there may be nothing to resolve. The assets, which makes up the companies may be long gone!

The ol'e saying goes, when you bend over, someone WILL eventually kick you in the tail end. The people involved in the policy structure of the port, extends on both sides--more on the side of the FNM, from the UBP and now to the new FNM. That's their people. The PLP boys, just jumped on the bandwagon when you guys decided you loved the people who owned the port, more than you loved the idea of the people in GB actually making a profit for themselves.

For me, I just want it done and over. Perhaps this is the final straw, where the PM would simply end all bets with that infernal structure, and start anew.

I had to look at that photo twice because I could have sworn that it was Mrs. Moxey-Ingraham!

You know, the actions of the Court of Appeal doesnt surprise me. They're a bunch of judicial bullies. What truly surprises and offends me is the actions of Justice Anita Allen. Since the lawyers in the GBPA matter are throwing their weight around, the Court of Appeal is laying interference and Justice Neville Adderley also wants to throw his name in the hat by entertaining interlocutory and substantive matters while the case is in front of Justice Allen what does she do? She grants an application by the lawyers in the case for her to recuse herself on the grounds of bias. I never saw such judicial cowardice in all my days. That's a disgrace. If you look at the judicial oath that she quotes it states that the duty of judges is to declare the laws and known customs of the realm without fear or favour, affection or ill-will. Her actions clearly show either fear or favour. I think she should have acknowledged the Court of Appeal ruling, dismissed the application for recusal and then invite the opposing party in the matter before Justice Adderley to bring an application before her court for an injunction to prevent Justice Adderley or any of the parties from proceeding before any other judges on the matter before her.

I think anyone with a brain can see what's going on. It's all politics. The PM increased Dame Joan's term in office, clearly the quid pro quo of that was that she would get Justice Allen off of the Port Authority case, the reason for this is because Justice Allen made a curious ruling to grant an injunction preventing Hayward from selling his shares which the government has said that it wants to buy. That's just my theory.

What Justice Allen ignores is the repercussions of her ruling. Since she acknowledged bias on her part she paved the way for Hayward to challenge the ruling of 50/50 share ownership of the Port. I take it the courts then rule he owns 75% of the Port, sells it to the government. The government buys it and then has a majority controlling interest in the Port. The government could always just take the shares from the St Georges and the Haywards but that would lead to actions for fundamental rights infringement. Talk about your hostile takeover.
