Bail revocation hearing adjourned

Defense lawyer Wayne Munroe has suggested that forfeiture proceedings against the women who stood bail for fugitive drug dealer Marvin Reckley are premature.
Reckley, 38, was a no-show for his scheduled June 2 trial in connection with the discovery of 103 kilograms of cocaine and 33 pounds of marijuana that were found in his apartment, off Gladstone Road, in June 2006.
As a result of his non-appearance, prosecutor Calvin Seymour asked the court to make the persons who signed his $100,000 bail forfeit the amount to the Crown.
However, Munroe said that he was aware, through press reports, that a headless male body had been found in South Beach. Munroe said no steps had been taken to determine if the unidentified man was Reckley.
Munroe also argued that Reckley's mother, Rosa Reckley, and Rosalie Moss, a family friend, had fulfilled their duties as suretors. He said they accompanied him to each of his court dates in the magistrates' court and were present for his scheduled court date.
Munroe said he wanted to question Police W/Inspector Brice about her affidavit in which she alleged that Reckley had breached his reporting conditions from February. As a condition of bail, Reckley was supposed to report to the Carmichael Road Police Station on Mondays, Wednesdays and Fridays.
But the officer alleged in her affidavit that Reckley had been inconsistent in his reporting since February. Munroe said that officers from the station had the authority to detain Reckley the next time he came to the station. He questioned why this was not done.
Justice Stephen Isaacs has adjourned the matter to July 16.
