I think that a person who knowingly has AIDS/HIV and sleeps around without informing their sexual partner should be charged with attempted murder. Its a different story if the individual shared that information.. The other party then have the choice to proceed or to walk away. If they proceed then its on them.

I am saying that anyone who does not admit that they are infected before having sex with the healthy person is a murderer, should be castrated, and should recieve life in prison without parole and isolated in a seperate section of the prison for treatment and rehabilitation, as all is not lost because they can be used to upkeep the prison with labour. they are still human despite what they have done and should not be treated like animals but still face hard prison time for 1st degree murder, i will always take the side of the victim......

Well, most elements can be proven. The infector was aware of his/her HIV status. The infector had sex with the alleged victim. Both can be proven. What will have to come out in court will be if deception was in play.

If the victim knowingly slept with an infected person, then their intent must've been to pass on the infection to another. Either that, or they intended to die from the infection. In either case, they would not file a complaint with the authorities.

As much as I would hope that can work, its not working, when one has that urge, all the education goes out the window, especially when one has the thinking that they are already in prison sentenced to death with a virus shattering thier future so the only thing left to do is CASTRATION, I SAY THAT VICKY BECAUSE IF YOUR CHILD IS IMPRISONED AND LATER FOUND INNOCENT AND IMMEDIATELY RELEASED, THAT VERY SAME RAPIST WITH HIV/AIDS OR EVEN GENITAL HERPES (which a lot of people forget because of the more widely discussed Aids) but supposed that infected person rapes your child, even though they may be released and try to live as best a normal live with treatment, its not fair to your child to recieve and earlier death sentence. Well thats a 50 50 thing their Vicky. I would put it more like this. The only way the infected person should go to jail and you know the rest of what should happen to them by now but if the infected person raped the healthy person then the consequences but if both parties had sex willingly and one gets infected, I still say that by law, if one knows they are infected, they should still be imprisoned if they are proven to not have told the person that they are infected. Now if its proven that both parties have no idea, then the condoms and education should have prevented the disease from spreading and both parties are to blame for not using protection because your health is your wealth and one should be responsible especially with all of the advertisements around the world via sight or radio....

Just for the record, even if an infected person rapes another infected person, the offender should still go to jail because rape is rape no matter what the circumstances are....

they are only riskin they lives because of people that are infected that have sex with them, so no question about it the blame lies 100% on the infected person, whether they know they are infected or not - if they know they are infected and then have unprotected sex then 100% they need to be dragged down the street and executed as the cold blooded murderers they are.

This is about infected person who know they have the virus willing have sex with a healthy person and do not tell them about their status. Yes I take the risk everytime I have sex whether it be protected or not that I may get pregnant and catch a STD. However, if the person I am about to have sex with have the disease unknown to me, he should disclose that information. If he didnt then he just handed me a death sentance and should be charged with murder.

Its both of their fault, not just the woman. Both should take the necessary steps to protect themself not only from STD's but also unwanted pregnancies. It takes two to make a baby not one.
