i am owner of a piece of property and leased the land out for one year. i informed them that i wanted to develop the land now i can not get them off. need help please tell me what to do.

First, some questions.

How long have the people remained on the land after the lease expired?

Was the lease written or oral?

Can you prove, with documents, that the land is yours? And, can you get your hands on the documents quickly?

Do you have a lawyer? Chances are you might need one in the long run. If you have a lawyer, your first step would be to have him write these people a letter requesting that they vacate the property. (Make sure you get a copy of the letter and keep it for your files.)

If you have the proper documents to prove that the land is yours, and the efforts of your lawyer is not working, then CALL THE POLICE. Let a few police officers escort you to the premises and make a request to the tenants in the presence of the police officers to remove themselves from your property. Now if they want to get rowdy the police right there :cop: . Now if its worth the tenants efforts to get rowdy then they will simply be arrested and removed from the property.

It seems that individuals in this country have no problem setting their behinds on other people's land, which has now escalated into the immigration problem we have now at the moment.

I think they only have 1 officer in that area of Long island :D , maybe a good idea to also call some family members for back up, as well as the officer, and a lawyer with Real Estate background if there is one in that area.

It is obvious that the lease has not expired as yet, otherwise there would not be an issue.
Seeing that the lease has not expired, there is no legal way for you to remove the tenants. Unless the tenants decide themselves that they want to leave, they rightfully can stay on the property until the lease has expired.
What I suggest is that you simply propose to offer some discount, or a small portion of funds to them in exchange for their departure. They may accept, if not....you're stuck.

the problem is the lease is up and i wrote letters to the persons to vacate the land.and they refuse they even were given a discount to see if the wanted to lease another year they refuse to do so, but will not get off. i tried to get them through the courts but it takes so long it been 7 months. documents are no problem i already have the proper titles and want to develop because it is prime land in nassau not long island. the area is commercial but they are the only house there

Ok....this is now mind-boggling.

First, one question, are they paying you some sort of rent now, while they are still there?

If not, I'm shocked that this has gone on so long, but read my suggestion below.....

If the lease is up...they have no rights to the property. Lemme tell you what to do. Monitor the house, when they leave, have a locksmith change the locks on all the doors. Then call the police. When they come home and can't get in, they'll get the picture. They cannot complain because you gave them sufficient time and warning to vacate the property. Once the lease has expired, they cannot say that is their house, or they have some agreement with you. There is nothing legally binding you from removing them from the property, and you have no obligation to them.

PERIOD.
