As a citizen in this country many things concern me in terms of how the country is run and the country's future. During this election season, many issues have been brought up one of which involves a section of the constitution possibly being breached. Im not sure if this have been dealt with before on this forum, but I wonder is there a penalty for breaching the constituiton. My question is based on this section of the Constitution, article 70 which states:
The Commission shall in accordance with the provisions of this Article, at
intervals of not more than five years, review the number and boundaries of the constituencies into which The Bahamas is divided and shall submit to the Governor-General a single report either-
(a) stating that in the opinion of the Commission, no change is required; or
(b) recommending certain changes, and the Governor-General shall cause such report to be laid before the House of Assembly forthwith.
According to the Leader of the Opposition the last time the Boundaries Commission met was between Noevember and December of 2001. That was more than 5 years ago. Although it may seem as a small issue to some, to me it needs to be addressed. Many problems begin small and when left unattended mushroom into huge problems.
So my question is should there be a penalty when a government or governing party breaches the constitution? If a man can go to jail or incur some other type of penaly for stealing (just an example) why can those responsible in government for upholding the supreme law of the land be penalized when they breach the constitution. In my view a penalty must be introduced if there isnt any and enforced.
If the youth of our nation realize that those in power can break the supreme law of the land and get away with it, why should they follow the rules set forth. What do you think?
