Editor Note: Justice Lyons ruled earlier this year that the Government broke the law in not appointing a Judicial Review Committee. He also ruled that the Judiciary was not independent of the political process. He invited the Attorney General and the Government to Appeal. The government pilloried him in the press. He put his reputation on the line saying that if the Appeals Court ruled against him, he would resign. He invited the AG to do the same. The AG appealed quietly at the 11th hour, and then last week apparently secretly and quietly withdrew the appeal.
This will probably be the headline in tomorrow's Tribune, but you guys will know ahead of time.
The AG's appeal of Justice Lyons ruling was set down to be heard before the Court of Appeal this morning. However, the AG's office apparently quietly filed a Notice of Withdrawal of the appeal on the 26th of March. Attorneys from the AG's office and Wayne Munroe, president of the Bar Association, went to Court this morning to hear the orders consequent upon the Notice of Withdrawal made. Justice Sawyer, President of the Court of Appeal, took the opportunity to make her views of the whole matter known. The Cabinet and the AG in particular, got the public ***-whuppin' of their lives. Justice Sawyer said that the public comments of the AG and other members of the cabinet were dishonest and insulting to the judiciary. Members of the press were in attendance.
Justice Sawyer pointed out that the Notice of Appeal itself specifically contradicted the public statements of the AG. The Notice of Appeal filed by the AG's office sought declarations that the judiciary remained independent and constitutionally qualified to sit and hear cases despite the Cabinet's failure to appoint a salary review commission, at the same time that the AG was publicly denying that the Cabinet had failed to appoint a commission. She also confirmed her agreement with Justice Lyons view that the section of the Judges Remunerations and Pensions Act which requires the appointment of a commission on a certain timetable is mandatory, i.e. the Cabinet was in breach of the law.
She read the Notice of Appeal out, ground by ground, in tones dripping with contempt and characterized the whole document as an insult to the judiciary and something that any competent lawyer should have known better than to file. In particular, she noted that the Notice of Appeal asked the Court to pronounce on its own competence, and said she would have refused to hear the appeal had it not been withdrawn. She said withdrawal of the appeal was a smart move.
In view of this, the Bloggy Boyz call for the resignation of the Attorney General, and her disbarment as a lawyer. Her job is to protect the judiciary and she smeared it. We are calling on the government to get rid of the scumbag Attorney General for breach of duty.
