Sticking to his word, Opposition Leader Perry Christie has filed an action in the Supreme Court challenging the appointment of Tanya Wright to the Senate and seeking a declaration that Prime Minister Hubert Ingraham "unlawfully fettered his discretion" in advising the governor general to make the appointment.

I think the idea of Political Balance needs to be addressed. Reading this, I would assume that this means that the PM is give the right to recommend these people to ensure that we do not have divided government, with the Senate being majority PLP and the HOA being FNM. If this is the intention of the section, the PM has done his duty. As a matter of consultation, consultation does not equate with concurrance. The PM got Christies opinion, he just didnt agree with him, which the Constitution does not require. The PLP needs to focus on being a better Opposition than they were Government. Maybe in Opposition they will be able to come up with alternate policy that may actually be of some use, and the FNM may consider incorporating. All of these small attempts to force a new election are sad, and what is even sadder is that the PLP had all the advantage going into the election, yet still lost, and now want a second chance. Even with the steroids of Haitians padding the register they could get a home run, so it time for the FNM to round the bases, and when they come up to bat, if they rest on their laurels or keep breaking promises, they too will strike out!

As far as the constitution is concerned there will never be one party leading the HOA and another leading the senate!!

The constitution says that the members of the senate should reflect the members in the HOA.

With that said, the PLP having the number of MPs that they do in the HOA should have been given the opportunity to name persons to fill the three seats in consultation with the PM....

Do the math.. HOA---- FNM 23 seats / 56.1% PLP 18 seats / 43.9%
SENATE----FNM 9 appointments 56.25% PLP 7 app 43.75%

Just a matter of fowwowing the constitution!!!

For a team who blamed the PLP for breaking the constitution over and over, iit amazes me to see that they seek to do the same!!!!

The first time I heard of Tanya Wright, was after the FNM won the election. I mean, she was the head of the COC for at least two years, or more I think, and the only time I have ever seen her, and I have been to the COC on many occasions asking for her, is when the FNM has now won the election.

I am sick and tired of these fair-weather political hacks. Either state your case, or state your business. You can support anyone who you wish, but, state your business if you want to be in front line politricks.

If she was "non-partisan", you would have heard about her before, during and after the election. You heard more about Phil Simon, the deputy director more so than her. Go figure!

Only one problem with your augment. The constitution does not say that in reflecting the HOA the senate has to do so percentage wise. That is a augment that the PLP is using to justify their case.
The constitution leaves this reflection of the HOA up to the PM, which is where the problem lies.
Ultimately it is up to the PM how the senate reflects the HOA.
don't get me wrong, I think that it is unfair as well but that is how the constitution is written.

Really, the PLP will make a fool of themselves. The constitution is duplicitous and it eventually leaves the balance of the senate to the PM. I wont be surprise if the court stop the PLP dead in their tracks.

Probably not. Since the made who helped in making the constitution, says otherwise. The FNM will be utter tyrants, if they disrespect the rule of the constitution. We will see...

You know what I find funny. This same Mr. Christie who said during the hight of the rush to get the boundaries cut weeks before May 2007 said literally that, "the constitution is not mandatory".

How then is this master hypocrite suddenly the advocate for the rule of law...esspecially the constitution?

Man! If you staying on one side, push for that one side. Don't talk to me out of your mouth, and turn right around and talk out of your behind, and then tell me that you were talking the same story all along!

I'm glad that he is recieving exactly what he gave me and the Bahamian people just weeks before a most important election! And in his own words, he should like it .....or LUMP IT! :hammer:

Should Mr. Christie have to take this action?? If the Constitution clearly states how the make up of the senate seats, and the process of appointments be carried out, why was this not followed by Prime Minister Ingraham? The controversy that now sorrounds the appointment of Ms. Tanya Wright would not be an issue today.

LOL..Basically. But you know how it is, the rule of law is only relevant when you want it to rule in your favor.

Ahhh .. who cares ... Christie gonna retire soon anyway .. he was looking tired during the election, was ill for the past couple years even on his death bed one time .. man he knows for his healths sake he gotta go sit this one out ..
