NASSAU — The ownership dispute over the Grand Bahama Port Authority took an "extraordinary" turn in the Supreme Court yesterday morning when Sir Jack Hayward's defence lawyer excused himself from the trial—not making a formal withdrawal, but simply declining to participate.
"I have instructions from my client not to participate further in this proceeding," said lawyer Gregory Moss just minutes after the trial began, a move that leaves Hayward's defence on tenuous ground.
It also drew the ire of the plaintiff's attorney, Fred Smith, who called the move "extraordinary' and criticized Moss's bowing out without making a formal withdrawal as "making a mockery of the court."
Senior Justice Anita Allen appeared at a loss herself, but ordered for the immediate continuation of the trial yesterday in the absence of Hayward's defence, saying, "The chips are going to fall where they may."...

We want to know what exactly had been done with the people's 7.5% share of the Ports profits.
Who's used it to build a fancy house? Which MP/Perm secretary/Civil servant do we lock up for teifin' and who do wet two slaps for plain ole stupidity?

Senior Justice Anita Allen yesterday said she would give Sir Jack Hayward another chance to present a defense in the Supreme Court dispute over Port Authority ownership, one day after he instructed his defense attorney not to participate in the trial.
"I don't want to be accused of rushing this judgment," said Allen at the beginning of court yesterday.
This newest round of leniency from the judiciary seems aimed at staving off a future appeal from Sir Jack whose claim to 75 percent of the Grand Bahama Port Authority is being challenged in court by the Edward St. George estate, which alleges it has a 50 percent stake in the company that runs Freeport.
Gregory Moss, Sir Jack's attorney, bowed out of the case Wednesday after failing to win an adjournment. Six witnesses have already testified without cross-examination from Moss, who has remained absent from the court. He is expected to appear tomorrow morning to indicate to the court whether Sir Jack had given him instructions to accept the judge's offer to cross examine the witnesses and begin participation in the trial.....

Anita Allen invited Mr Moss, Sir Jack Hayward Lawyer to cross examine the witnesses but he refuse on the grounds that his client may be at a disadvantage, because his client would not be present. He still didn't give the court a time in which Sir Jack will be available to attend court. Anita Allen said that she will hand down a ruling in two weeks. An appeal is expected.
It is my opinion that Sir jack Hayward conduct is rather rude and disrespectful to the court. It appears that Sir Jack have a lot to hide. I believe it is all a game. But I hope that the Bahamian peoples 7% will be cleared up soon. I want my damn money and i want it now. All our government leaders needs to account for the mystery of the 7%. Firstly, the treasurer needs to make a public statement relative to his knowledge and let the chips fall where they may. We need to hear from Hubert Ingraham and we need to hear from Perry Christie.
I just want to know whether we sold our shares and to whom? If the shares were sold, why was it not debated in parliament? And if we still own shares where the hell did the money go? Did it go to the treasury or did it go into someones pockets over the years. We need to know!!!

Second Chance 08-04-07, - 08:30 PM What gets me with this case is that the white man trying to screw one of his own. Usually they say that it's black people that can't be trusted...that you must watch...and that's always trying to "swing" one another. This is a testament that they are NO BETTER...they just do it in greater monetary amounts...but they always try to come off so humble. I am by no means racist...and apologize for generalizing...but I see too much of this that is just swept under the carpet in investment banking...and they always looking to "settle".
